Terms and Conditions

These Terms and Conditions (“Terms”) govern the relationship between Prodigal Money (“Prodigal Money,” “we,” “our,” or “us”), the brand under which ZAP TECH PRIVATE LIMITED provides accounts-receivable management services in the United States, and (a) consumers whose accounts are placed with us by original creditors of record, and (b) creditor clients and business visitors who interact with our websites and services.
By accessing or interacting with the Services, you acknowledge that you have read and agree to these Terms and to our Privacy Policy and SMS Policy.
1. About Prodigal Money
Prodigal Money is a brand and division of ZAP TECH PRIVATE LIMITED, an Indian private company (CIN U74900PN2012PTC143202), ISO/IEC 27001:2022 certified, headquartered at 534, Amanora Chambers, Amanora Park Town, Hadapsar, Pune – 411028, Maharashtra, India, with U.S. operations in Michigan and licensed coverage in applicable U.S. states.
2. Services
Prodigal Money provides accounts-receivable management and related servicing for U.S.-based consumer accounts placed with us by original creditors of record. Services include:
- Compliant multi-channel consumer contact (voice, SMS, email, mail)
- Account-status communication and payment-arrangement facilitation
- Secure payment processing through PCI-DSS-compliant providers
- Dispute intake, validation handling, and remittance to creditor of record
3. Regulatory Framework
Prodigal Money operates in compliance with applicable U.S. federal and state laws, including:
- Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. § 1692 et seq.
- Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227
- State debt-collection licensing and bonding requirements
- Consumer Financial Protection Bureau (CFPB) Regulation F
- CTIA Short Code Monitoring Handbook and 10DLC carrier requirements
- California Consumer Privacy Act (CCPA) / CPRA where applicable
4. Consumer Rights
If your account has been placed with Prodigal Money, you have the following rights under the FDCPA and related laws:
- Right to validation: Within five (5) business days of our initial communication, you will receive a written validation notice identifying the debt, the creditor of record, the amount due, and your rights.
- Right to dispute: You may dispute the debt or any portion of it. Submit disputes via the consumer page, by email to disputes@prodigalmoney.com, or in writing to the address in §15.
- Right to cease communication: You may request in writing that we cease further communication, per FDCPA §1692c(c).
- Right to opt out of SMS: At any time, by replying STOP to any SMS, calling our consumer line, or contacting us via any channel in §15.
- Right to identity-theft assertion: If you believe the account does not belong to you due to identity theft, submit a sworn statement with police report and we will pause activity pending investigation.
5. Acceptable Use of Websites and Services
You agree not to:
- Use our websites or Services to engage in unlawful, deceptive, or abusive conduct
- Misrepresent your identity or another person’s consent
- Reverse engineer, disrupt, or compromise the security of our systems
- Use automated means to scrape or collect data from our public pages without permission
6. Payments
- Payments toward placed accounts may be made via secure online portal, phone, mail, or other channels we designate.
- All electronic payments are processed by PCI-DSS-compliant third-party processors.
- Receipts are issued for every payment received.
- Payment of any amount does not by itself constitute admission of liability if you have raised a valid dispute.
7. Intellectual Property
All content on our websites, including the Prodigal Money name and logos, is the intellectual property of ZAP TECH PRIVATE LIMITED or its licensors. Limited use is granted for personal non-commercial purposes only.
8. SMS and Communication Policy — 10DLC Disclosures
Brand identification: SMS messages are sent from Prodigal Money, a brand and division of ZAP TECH PRIVATE LIMITED, via carrier-compliant 10DLC infrastructure.
Use case: Account notifications, payment reminders, payment-arrangement options, account-status updates, dispute-handling communications, and customer support, in connection with accounts placed with us by original creditors of record.
Message frequency: Varies depending on the stage of account servicing. Typical range: 0–4 messages per week per consumer.
Carrier disclosure: Msg & data rates may apply.
HELP: Reply HELP to any SMS for assistance. You will receive a reply with our consumer support contact details.
STOP / opt-out: Reply STOP (or END, QUIT, CANCEL, UNSUBSCRIBE, OPTOUT, REVOKE) to any SMS to unsubscribe immediately. You may also opt out by phone, mail, or email per §15.
Non-sharing: Mobile telephone numbers and SMS opt-in records are not shared with any third party or affiliate for marketing purposes. They are processed solely for the account-servicing communications described above through Twilio Inc., our 10DLC carrier-compliant messaging provider.
Consumer consent to receive SMS messages from Prodigal Money originates at the time of agreement with the original creditor of record and transfers to us under the placement assignment per FDCPA and CTIA Short Code Monitoring Handbook §5.2. Full SMS practice disclosures, sample messages, opt-in keywords, and example flows are documented in our dedicated SMS Policy.
9. Mini-Miranda Disclosure (FDCPA §1692e(11))
In our initial communication and as required by FDCPA, Prodigal Money discloses that we are attempting to collect a debt and that any information obtained will be used for that purpose. This disclosure appears in our validation notice and, where applicable, in initial SMS, voice, and email communications.
10. Limitation of Liability
The Services are provided “as is.” To the maximum extent permitted by law, Prodigal Money and ZAP TECH PRIVATE LIMITED are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of our public websites, except for liability that cannot be limited by law.
11. Termination
We may suspend or terminate access to our websites or Services for any breach of these Terms. Termination does not affect rights or obligations accrued prior to termination.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date.
13. Governing Law and Disputes
These Terms are governed by applicable U.S. federal and state law for matters concerning U.S. consumers. Disputes shall be resolved per applicable consumer-protection law and, where required, through CFPB and state-attorney-general procedures available to U.S. consumers.
14. Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
